1. Who can use the Site

The Site is intended for adults 18 and older. By using it or joining the waitlist, you confirm you are at least 18.

2. The waitlist

• Joining the waitlist lets us contact you with launch updates and related announcements. You can unsubscribe at any time using the link in our emails.
• Joining does not guarantee access to the app, any particular features, pricing, or a launch on any timeline. The app may change or may not launch at all.
• You agree to provide accurate information and not to sign up using false identities, bots, or automated means.

3. Electronic communications

By using the Site or joining the waitlist, you consent to receive communications from us electronically (such as emails and notices posted on the Site). You agree that these electronic communications satisfy any legal requirement that a communication be in writing.

4. Acceptable use

You agree not to misuse the Site, including by attempting to disrupt or gain unauthorized access to it, scraping or harvesting data, uploading malicious code, infringing others’ rights, or using it for any unlawful purpose. We may suspend or remove access, and remove anyone from the waitlist, at our discretion.

5. Referral program

If we offer a waitlist referral program, the following apply:

• Referrals must be genuine. Fake, automated, purchased, or spam signups are prohibited and may be removed.
• Any waitlist position, rewards, or perks have no cash value and are not transferable.
• We may change, pause, or end the referral program, and adjust or revoke positions or rewards obtained through prohibited activity, at any time.

6. Feedback

If you send us ideas, suggestions, or other feedback about the Site or the Wingit app, you grant us a perpetual, royalty-free right to use it for any purpose without any obligation or compensation to you.

7. Intellectual property

The Site and its content, including text, design, graphics, logos, and the “Wingit” name and branding, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive license to view the Site for its intended purpose. You may not copy, reproduce, or use our content or branding without our permission.

8. Third-party links and services

The Site relies on and may link to third-party services we don’t control (for example, our email provider, hosting, the Apple App Store, Google Play, or social media). We are not responsible for those services or their content, and your use of them is governed by their own terms.

9. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure, and we make no promises about if or when the Wingit app will become available.

10. Limitation of liability

To the fullest extent permitted by law, Wingit will not be liable for any indirect, incidental, consequential, or special damages arising out of or relating to your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Wingit and its owners, employees, and agents from any claims, damages, losses, or costs (including reasonable legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Changes to the Site and these Terms

We may modify or discontinue the Site, the waitlist, or the referral program at any time. We may also update these Terms; the updated version will be posted here with a revised “Effective” date, and your continued use of the Site means you accept the changes.

13. Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You agree to first try to resolve any dispute with us informally by contacting us. Any dispute that is not resolved informally will be handled in the state or federal courts located in New York.

14. General

These Terms (together with our Privacy Policy) are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms; we may assign ours, including in connection with a merger, financing, or acquisition.

1. Information we collect

• Information you give us. When you join the waitlist, we collect your email address (and any optional details you choose to provide, such as a name).
• Information collected automatically. Like most websites, we (and our service providers) may collect basic technical data such as your IP address, device and browser type, referring page, and pages viewed, using cookies and similar technologies for analytics and security.

2. How we use information

• To add you to the waitlist and send you launch updates and related announcements.
• To operate our referral program, if you take part in it (for example, to create and count referral links).
• To measure interest, understand site traffic, and improve our website.
• To prevent spam, abuse, and fraud, and to keep the site secure.
• To comply with legal obligations.

3. How we share information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only with:

• Service providers that operate the site on our behalf, including our hosting/CDN provider (Cloudflare), our email/waitlist provider (Tally), and our website analytics provider (Cloudflare Web Analytics), who may process data only to provide their services to us.
• Legal and safety, if required by law, or to protect our rights, users, or the public.
• Business transfers, in connection with a merger, financing, or acquisition.

The categories of personal information we collect are identifiers (such as your email address) and internet or device activity (such as analytics data). We disclose these categories only to the service providers above, for the business purposes described in this policy.

4. Cookies and analytics

Our website analytics (Cloudflare Web Analytics) are privacy-friendly and do not use cookies to track you. We and our providers may still use limited cookies and similar technologies for security and basic site functionality. You can control cookies through your browser settings, and where required by law we will ask for your consent before using non-essential cookies.

5. Your choices and rights

• Unsubscribe anytime using the link in any email we send, or by contacting us.
• Access, correct, or delete your data. You can ask us to confirm, correct, or delete the information we hold about you by emailing hello@heywingit.com.
• U.S. state privacy rights. Depending on where you live (for example, California and other states with privacy laws), you may have the right to access, correct, delete, and obtain a copy of your personal information, and to opt out of its “sale” or “sharing.” We do not sell your personal information. To exercise a right, email hello@heywingit.com.
• Opt-out preference signals. Where required by law, we honor recognized opt-out preference signals, including Global Privacy Control (GPC).
• Appeals. If we deny your request, you may appeal by emailing hello@heywingit.com. Depending on your state, you may also contact your state attorney general.

6. Data retention

We keep waitlist information until you unsubscribe or ask us to delete it, or until it is no longer needed for the purposes above.

7. Security

We use reasonable administrative, technical, and physical measures to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

8. International users

We operate the site from the United States and process information there. If you access the site or join the waitlist from outside the United States, you understand that your information will be transferred to and processed in the United States, where data-protection laws may differ from those in your location.

9. Third-party links

The site may link to third-party websites or services we don’t control (for example, the Apple App Store, Google Play, or social media). This policy does not apply to those sites, and we are not responsible for their privacy practices. Review their policies before providing information.

10. Changes to this policy

We may update this policy from time to time. We will post the updated version here and revise the “Effective” date above. Significant changes will be communicated where appropriate.
